TERMS & CONDITIONS

Last updated: 1 October 2026

These Terms of Service ("Terms") govern your access to and use of the Getahead platform, including our mobile applications, website, web application, software and related services (together, the "Services").

These Terms incorporate our Privacy Policy and any other terms we present to you at the point you use a particular feature.

The Services are owned and operated by Get Ahead Mindset Ltd, a company registered in England and Wales (company number 11255446), registered office 102-108 Clerkenwell Road, London, England, EC1M 5SA. In these Terms, "Getahead", "we", "us" and "our" mean Get Ahead Mindset Ltd.

1. AGREEMENT

Please read these Terms carefully before using the Services. By downloading, installing, accessing, registering for or using the Services, you agree to these Terms, which form a legally binding contract between you and Getahead. If you do not agree to these Terms or our Privacy Policy, do not use the Services.

Nothing in these Terms affects your statutory rights as a consumer. Where any term conflicts with your statutory rights, your statutory rights prevail.

2. IMPORTANT INFORMATION ABOUT THE SERVICES

This section is important. Please read it in full.

The Services are not a medical or healthcare service. Getahead provides mental performance training for sport and fitness. The Services are not designed to diagnose, treat, cure or prevent any medical or psychological condition. Nothing provided through the Services constitutes medical, psychological, psychiatric or other professional healthcare advice, and nothing should be relied upon as a substitute for it.

Your Mental Edge report is not a clinical assessment. Your assessment results, mental fitness score, identified patterns and insights describe patterns in the answers you have given. They are not diagnoses, clinical evaluations or predictions about your mental health.

The Getahead coach is an automated system. Unless we tell you otherwise at the point of use, the coach within the Services is automated and is not a person. It is built on established sport and performance psychology and developed with qualified psychologists, but it is not a therapist, counsellor or clinician, and it cannot provide crisis support or treatment.

If you have or suspect you have a mental health condition, or if you are receiving treatment or taking medication, please speak to your GP or a qualified professional before using the Services, and continue to follow their advice. Never disregard or delay seeking professional advice because of something provided through the Services.

The Services are not for emergencies. If you or someone else is at risk of harm, do not use the Services to seek help. Call 999, contact Samaritans on 116 123, or text SHOUT to 85258.

Where information you provide indicates a risk of death or serious harm to you or another person, we may act on it, including by surfacing crisis support resources and, in serious cases, contacting the emergency services. See our Privacy Policy.

Physical activity. Where the Services relate to or accompany physical training, you are responsible for training safely and within your capabilities. If you have any medical condition or concern, consult a doctor before undertaking physical activity.

3. ACCOUNTS

Age

The Services are intended only for individuals aged 18 or over. If you are under 18, we may refuse access to, suspend or delete any account we believe belongs to someone under that age.

Registering

To use the Services you must create an account. When you do, you agree:

  • To provide accurate, current and complete information about yourself, and to keep it up to date;

  • To create one account only, for your own personal use;

  • Not to share your account or subscription with anyone else;

  • That the activity recorded on your account is genuinely yours; and

  • That we may suspend or terminate your account if you breach these Terms.

Account Security

You are responsible for keeping your password confidential and for all activity that takes place under your account. Notify us immediately at hello@getaheadmindset.com if you believe your account has been accessed without your authorisation.

Third-Party Sign-In

You may be able to register or sign in using a third-party account such as Apple or Google. If you do, you authorise us to receive the information necessary to create and access your account. Your use of that third-party account is governed by that provider's own terms and privacy policy, for which we are not responsible.

4. SUBSCRIPTIONS, FEES & PAYMENTS

Free and Paid Features

Some features of the Services are free. Others require a paid subscription. These Terms apply whether you use free or paid features. We may add, change or withdraw features at any time, subject to Section 11.

Subscription Plans

Our current plans are:

  • Monthly — £14.99 per month

  • Annual — £99.99 per year

Prices include VAT where applicable. Depending on your payment provider you may incur additional charges, such as foreign transaction fees, for which we are not responsible.

When you subscribe, you choose your plan and billing period. Your plan cannot be changed mid-term but you may switch at your next renewal.

Free Trial

We may offer a free trial. A free trial may be used once only. The trial length will be stated at sign-up. Unless you cancel at least 24 hours before the trial ends, your subscription will begin automatically and you will be charged the subscription fee. We will tell you clearly, before your trial starts, when it ends and what you will be charged.

Payment

You must provide a valid payment method. You authorise us, or the relevant app store, to charge that method for the fees due. If you subscribed through the Apple App Store or Google Play, payment is handled by that store and you can manage your payment method and subscription through your store account.

Automatic Renewal

Your subscription renews automatically at the end of each billing period, at the then-current price, until you cancel. To avoid being charged for the next period, you must cancel at least 24 hours before your current period ends.

We will send you a reminder before each annual renewal, and before any free trial converts to a paid subscription.

Cancelling

You can cancel at any time. Cancellation takes effect at the end of your current billing period, and you keep access to paid features until then. We do not require you to call or email us to cancel — you can cancel:

  • In the app at Settings → Subscription;

  • Through the Apple App Store or Google Play, if you subscribed there; or

  • By contacting us at hello@getaheadmindset.com.

Cancelling does not automatically delete your account or your data. To delete your account, see Section 12.

Your 14-Day Right to Cancel

As a consumer you normally have 14 days from entering into the contract to cancel and receive a refund, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Because the Services are digital content made available to you immediately, when you subscribe you will be asked to expressly request immediate access and to acknowledge that doing so means you lose your 14-day right to cancel once the Services have been supplied. If you do not give that acknowledgement, we will not provide access until the 14 days have passed.

This does not affect your right to cancel your subscription for future billing periods at any time, as set out above.

Price Changes

We may change our prices. We will give you at least 30 days' notice before any price change affects you, and any change will take effect at your next renewal. If you do not wish to pay the new price, you can cancel before it takes effect.

Refunds

Except where these Terms say otherwise, or where you have a statutory right to a refund, subscription fees are non-refundable. If you subscribed through an app store, refunds are handled under that store's policies.

Nothing in this section affects your rights under the Consumer Rights Act 2015 if the Services are faulty, not as described, or not provided with reasonable care and skill.

Promotional and Referral Codes

We may offer promotional or referral codes from time to time. These are offered at our discretion, on the terms stated alongside the code, and may be withdrawn at any time.

Subscriptions Through Partners

You may be able to obtain access through a partner, such as an event organiser or coach. The price, duration and terms will be presented to you at that point. Access obtained this way runs for the period purchased and does not renew automatically unless stated.

5. YOUR CONTENT

"Your Content" means anything you create, submit or share through the Services, including your assessment responses, check-in notes, coach conversations, and any text, audio or images you provide.

You keep ownership of Your Content. You confirm that you own it or have the right to provide it, and that providing it does not infringe anyone else's rights.

Licence to us. To operate the Services, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, adapt and analyse Your Content solely for the purposes of providing, maintaining and improving the Services to you, and as set out in our Privacy Policy.

This licence is limited to what we need in order to run the Services. We do not use Your Content for advertising, we do not sell it, and we do not publish it. It ends when you delete Your Content or your account, except where we are required to retain it by law or where it has been anonymised.

6. FEEDBACK

If you send us feedback, suggestions or ideas about the Services, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use them without restriction or compensation. Please do not send us feedback if you do not wish to grant this licence. Feedback is not treated as Your Content under Section 5.

7. ACCEPTABLE USE

You agree not to:

  • Use the Services for any unlawful purpose, or in breach of these Terms;

  • Resell, sublicense or commercially exploit the Services, or charge anyone for access to them;

  • Use the Services on behalf of an organisation, team or club without our written agreement;

  • Copy, modify, reverse engineer, decompile or create derivative works from the Services, except as permitted by law;

  • Access the Services other than through the interfaces we provide;

  • Use automated means — including scraping, crawling, bots or data mining — to access or extract data from the Services;

  • Attempt to gain unauthorised access to any part of the Services, or to another user's account;

  • Interfere with, disrupt or place unreasonable load on the Services; or

  • Send us abusive, threatening, harassing or otherwise offensive communications.

We may suspend or terminate your access if you breach this section.

8. PERSONALISATION & AI FEATURES

Personalisation is central to the Services. We use information about you and your use of the Services to generate your reports, build and adapt your training plan, and tailor the content you receive.

We use artificial intelligence, including large language models, to deliver certain features ("AI Features"), as described in our Privacy Policy. AI has known and unknown limitations and can make mistakes. You use AI Features at your own risk and should apply your own judgement to anything they produce, particularly where it relates to your health, wellbeing or physical training.

Our workout library and the methodology behind it were developed by qualified sport and performance psychologists. AI determines which content you receive and when; it does not generate the underlying methodology.

Nothing in this section limits Section 2 or your statutory rights.

9. OUR INTELLECTUAL PROPERTY

The Services, including all software, content, workouts, assessments, methodology, text, audio, graphics and design, and the Getahead name and logo, are owned by us or our licensors and are protected by intellectual property laws.

We grant you a limited, personal, revocable, non-transferable, non-exclusive licence to access and use the Services for your own personal, non-commercial use, in accordance with these Terms. All rights not expressly granted are reserved.

You may not use our name, logo or branding without our prior written permission.

If you believe content on the Services infringes your intellectual property rights, contact us at hello@getaheadmindset.com with details of the work concerned, the material you say is infringing, your contact details, and a statement that you have a good-faith belief the use is unauthorised.

10. THIRD PARTIES

The Services may contain links to, or integrations with, third-party websites, products or services. We do not control these and are not responsible for their content, availability, terms or privacy practices. Any dealings you have with a third party are between you and that third party.

11. CHANGES TO THE SERVICE

We may improve, modify, suspend or discontinue the Services or any part of them. Where a change is material and adversely affects you, we will give you reasonable notice, unless the change is required for legal, security or technical reasons.

If we permanently discontinue a paid feature you have subscribed to, you may cancel and we will refund a proportionate amount of any fees you have paid in advance for the unused period.

12. SUSPENSION, TERMINATION & DELETION

You can end this agreement at any time by cancelling your subscription (Section 4) and deleting your account at Settings → Account.

We may suspend or terminate your account where: you breach these Terms; we are required to by law or by a regulator; there are unresolved security or technical issues; you have not paid fees due; or your account has been inactive for more than 24 months, after we have contacted you.

Except where you have breached these Terms or the law, we will give you reasonable notice before terminating, and will refund a proportionate amount of any prepaid fees for the unused period.

When your account is deleted, your data is handled as described in our Privacy Policy. Deletion is permanent and cannot be reversed.

Sections 2, 5, 6, 9, 13, 14, 15 and 17 survive termination.

13. OUR RESPONSIBILITY TO YOU

We do not exclude or limit our liability to you in any way where it would be unlawful to do so. This includes liability for:

  • death or personal injury caused by our negligence;

  • fraud or fraudulent misrepresentation;

  • breach of your statutory rights in relation to the Services, including under the Consumer Rights Act 2015; or

  • any other liability that cannot lawfully be excluded or limited.

Subject to that, and to the maximum extent permitted by law:

  • We provide the Services with reasonable care and skill, but we do not guarantee that they will be uninterrupted, error-free, or that they will produce any particular result or level of performance.

  • We are not liable for loss or damage that was not foreseeable — meaning loss or damage that was not an obvious consequence of our breach, and was not contemplated by both of us when you began using the Services.

  • We are not liable for business losses. The Services are provided for personal use only. If you use them for any commercial or business purpose, we have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity.

  • Our total liability to you in respect of all claims arising in any 12-month period will not exceed the greater of (a) the total fees you paid us in the 12 months before the claim arose, or (b) £100.

14. YOUR RESPONSIBILITY TO US

You are responsible for your use of the Services. If you breach these Terms and that causes us to suffer loss or incur costs or claims from a third party, you agree to compensate us for reasonably foreseeable losses arising directly from that breach.

This does not apply where the loss arises from our own breach, negligence or failure to comply with the law

15. COMPLAINTS & DISPUTES

Please contact us first. If you have a problem, email hello@getaheadmindset.com and we will try to resolve it. We aim to acknowledge complaints within 5 working days.

Alternative dispute resolution. We are not required to, and do not, agree to use alternative dispute resolution, but we will tell you if that changes when we respond to your complaint.

Courts. These Terms are governed by the law of England and Wales. If you are a consumer resident in Scotland or Northern Ireland, you may bring proceedings in your own courts, and the law of your home nation may apply. You may bring proceedings against us in the courts of England and Wales, or in the courts of the country where you live. We will only bring proceedings against you in the courts of the country where you live.

Nothing in these Terms requires you to give up your right to go to court.

16. CHANGES TO THESE TERMS

We may update these Terms. Where a change is material, we will give you reasonable advance notice by email or in the app. If you do not accept the change, you may cancel your subscription and stop using the Services before it takes effect. Continuing to use the Services after a change takes effect means you accept the updated Terms.

The effective date at the top of these Terms shows when they were last updated

17. GENERAL

Entire agreement. These Terms and the documents they refer to make up the entire agreement between you and us regarding the Services.

No waiver. If we do not immediately enforce a right, that does not prevent us doing so later.

Severability. If any provision is found to be unlawful or unenforceable, the remainder continues in force.

Transfer. You may not transfer your rights or obligations under these Terms without our written consent. We may transfer ours to another organisation, and will tell you if we do. If you are unhappy with the transfer you may cancel and we will refund any prepaid fees for the unused period.

Third-party rights. Except as set out in Section 18, no one other than you and us has any rights under these Terms.

No partnership. Nothing in these Terms creates a partnership, joint venture, employment or agency relationship between us.

Language. These Terms are written in English, and the English version prevails over any translation.

18. APP STORE TERMS

These Terms are between you and Getahead, not with Apple or Google.

Where you download our app from the Apple App Store: Apple is not responsible for the app or its content, and has no obligation to provide support or maintenance. Apple is not responsible for any claim that the app fails to conform to any legal requirement, for third-party intellectual property claims, or for product liability claims relating to the app — these are our responsibility, subject to these Terms. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties. You must comply with any applicable third-party terms when using the app.

Where you download our app from Google Play: your use is also subject to the Google Play Terms of Service, and Google is not responsible for the app or its content.
